Seasoned Attorneys Fighting Family Medical Leave Act Discrimination in Los Angeles, CA

Diligently protecting the rights of employees in California

There are many valid reasons to take time off from work.  At The Ruttenberg Law Firm, PC in Los Angeles, we protect your rights under the federal Family Medical Leave Act (FMLA) to take a leave of absence without suffering harsh employment consequences. If you do face discrimination, we aggressively pursue all avenues of recovery to help you obtain relief and justice.

Employee Rights under FMLA

FMLA is a law that protects employees who take leaves of absence from their jobs because of their own medical conditions or those of a family member. Under FMLA, applicable employees are entitled to up to 12 weeks of job-protected, unpaid leave for certain reasons. These include:

  • Birth of a child, also referred to as pregnancy leave
  • Adoption or fostering of a child
  • Care of an immediate family member — e.g., spouse, child, or parent
  • An employee’s own serious health condition

An eligible employee may also request up to 26 weeks of FMLA leave during a 12-month period to care for a service member — the National Guard, Armed Forces, or Reserves — who is a member of the employee’s immediate family.

FMLA discrimination

During leave, employers must sustain an employee’s group health benefits. Employees who return from FMLA leave must be allowed to assume their original job — or an equal job with equal pay, benefits and terms and conditions. While employers may not retaliate against employees for taking FMLA leaves, they may take adverse action for other valid reasons.

If you were terminated, demoted, refused work benefits, denied reinstatement or otherwise discriminated against because you exercised your rights under FMLA, our Los Angeles attorneys at The Ruttenberg Law Firm, PC have the strong legal skills, experience and deep roots in the California legal community to help you obtain relief including:

  • Lost wages
